 The Employees of the court have come up with this list of frequently asked questions to assist you with your court needs. Please take a moment to review these questions prior to contacting the Court.

How can I get copies of filed information?

You need to send your request in writing along with a self addressed stamped envelope for return mail.  Indicate the case number, party named, date of birth and date of filing (if known).  If you do not have a case number it will be considered a record request.  Record search is $5.00 for a 15-year period per name.  Copies are 50 cents per page.  If you do not know how many pages need to be copied, call the court or send your check stating, “Not to exceed $25.00”

How far back can I search for records?

Our current computer system dates back to June 1996.  Records prior to that can be located in our records index books that date back to 1978.  Any records prior to that may be obtained on microfilm or microfiche.  Most of our files are stored off site, so you may have to request a file to be retrieved, which may take a day or two to get back to the court.  The court will retain the file for two weeks before sending it back to storage, so if you wish to view the file, you must do so during that time frame.

How do you get my name for jury duty?

It is your civic duty to serve as a juror.  Juror names are retrieved from voter registration and the Department of Motor Vehicles.

Why have I gotten more than one jury summons in a one year time frame?

Since names are retrieved from two areas, they may read separately if there is a different spelling on the name, address or incorrect date of birth.  If you should get summoned more than once, call the jury commissioner and she will be more than happy to assist you to see if maybe your name has entered as a duplicate.  The jury commissioner can be contacted at (209) 754-6306.

Where do I need to attend traffic school?

Calaveras Superior Court will recognize any traffic school in the State of California. 

Can I do traffic school online/video?

No. Calaveras Superior Court does not recognize online or video traffic schools.  You will physically need to attend a school. 

When are Department 1 ex-parte motions heard?

Daily at 11:45 a.m..

When are Department 2 ex-parte hearings?

Monday, Tuesday and Thursday: 11:00 a.m.
Wednesday at 2:00 p.m. Friday at 10:30 a.m.

There is a warrant out for my arrest.  What can I do?

As of July 1, 2004, if you have an outstanding warrant you MUST surrender yourself to the Jail where you may post bail and be given a date to appear in Court or be brought before the Judge. In most instances, persons surrendering themselves to the Jail by 11:00 a.m. on a Court business day will be processed and brought to the Court to appear before the Judge on the 1:30 p.m. in-custody calendar.

On my courtesy notice, do I pay both dollar amounts if I want to attend traffic school?

No.  The total bail amount to attend traffic school is the base fine plus a $24.00 administrative fee.  For example:  If the TOTAL BAIL AMOUNT is $144.00, you will need to submit a check or money order in the amount of $168.00.

The DMV is telling me I need an abstract.  What is that?

At some point, the court has imposed restrictions or a hold on your driver’s license.  You will need to contact the court to find out what is needed to release the restrictions.  The court does not issue manual abstracts unless it is a re-referral to a program.  The court is on-line with DMV and if your fine has been paid in full the court will release your hold.

Am I eligible for traffic school?"

You are eligible to attend traffic school if the following apply:

You do not hold a commercial class A, B, or C drivers license;
You were not driving a commercial motor vehicle (as defined in VC 15210(b)) at the time of the offense;
You have not attended traffic school within the past 18 months from violation date to violation date;
You did not exceed the speed limit by more than 25 miles per hour;
The charge does not involve alcohol;
The charge does carry a point count.

Can I attend traffic school if I have attended within 18 months or if I am not eligible?

You will need to calendar your case before the judge to request traffic school.  If allowed to attend you may be ordered to attend a 12 hour enhanced program. 

When can I calendar my case to be heard by the court?

The court cannot advance your case on calendar if you have been sent a cite letter to appear from the District Attorney or if you have a court date that was previously set by a signed citation or set by the court.

You must contact the court to have your case put on calendar to be heard before a judge.   If you have received a courtesy notice, these matters are heard every Monday at 10:30 a.m.

If your case is a traffic misdemeanor, these matters are heard every Monday at 10:00 a.m.

If you have been charged with a criminal misdemeanor or felony, these matters are heard every Tuesday at 2:00 p.m.

Can I pay with a credit card or ATM?

No. At this time, Calaveras Superior Court can only accept cash (do not send cash through the mail), personal checks, money orders, or cashier’s checks.

 

Civil

When are family law motions heard? 

Tuesdays at 9:00a.m. in Department 1.

When are unlimited civil motions heard?

Tuesdays at 10:00a.m. in Department 1.

When are limited civil motions heard?

Wednesdays at 9:00a.m. or 2:00p.m. in Department 2.

When are Department 1 ex-parte motions heard?

Daily at 11:45 a.m..

When are Department 2 ex-parte hearings?

Monday, Tuesday and Thursday: 11:00 a.m.
Wednesday at 2:00 p.m. Friday at 10:30 a.m.

Do you have packets available?

Yes, though packets may not include all of the forms needed for your action.  Please review the packet carefully, if any further Judicial Council forms are needed please go to www.courtinfo.ca.gov/forms/.
